Seinfeld Has The Soup Nazi - The Siena at Montclair Has Brian Stolar and Jonathan Litt

No soup for Jerry and no clean air for the residents of the Siena.

After a four years of repeated requests to Brian Stolar of Pinnacle Companies and Jonathan Litt of Kohl Construction to repair our home, not only have they declined to repair the leaks and remove the black mold, they have also declined to provide us with an air filter to help make the air we are breathing safe.  In March of 2011, leaks once again infiltrated the bedroom and all windows in our unit.  Kohl came in, ripped out the wall and put sheetrock back up.  The wall was never finished as within days, water was coursing through the ceiling again.  It has been 12 months and Pinnacle and Kohl have neglected to even attempt to correct the problem.  As a matter of fact, they don't even seem to care that the air we are breathing is dangerous and has resulted in visits to the emergency room with a bronchial infection, constant allergy like symptoms and general malaise.  As Brian Stolar attampts to raise money for a NEW PROJECT in Montclair, I invite any potential investor to come to my unit to see exactly the kind of quality they will be getting. 

It is an absolute atrocity that the township leaders have not once come to The Siena to see the problems of the taxpayer, that, with the exception of Councilor Renee Baskerville, they readily dismissed the problems at The Siena and backed Pinnacle Companies to lead the most important redevelopment project in recent memory, and have placed the health of the very people who put them in office behind their egos - SHAME ON YOU ALL.

Regardless, we all continue to live in an unhealthy environment due to the standards of Brian Stolar and Jonathan Litt.  They have taken no action to help us and it is all but apparent that they don't care about the people who purchased units from them or the township in general - their only agenda is to make money from the people who trusted them.  Shame, shame, shame.

OVERTURN THE COUNCIL DECISION TO WORK WITH PINNACLE!

Over the next couple of months, we will be working with concerned community members to canvass Montclair for signatures to overturn the incredibly poor decision to approve Pinnacle as the named developer for the DCH Gateway program.  Stay tuned and keep your eyes open for our petitions at local grocery stores and cafes.

PROTECT MONTCLAIR AND THE PROPOSED DCH/MONTCLAIR REDEVELOPMENT SITE!!!

The Siena at Montclair, a 101 unit mixed use luxury residential, was built through a partnership between Pinnacle Companies, headed by Brian Stolar and Kohl Construction under the direction of Jonathan Litt.  My partner & I purchased a 2 bedroom unit in the pre-construction phase with the dream of living in an upscale apartment with a view of Manhattan.  Approximately three weeks after closing, I reported the first leaks in my unit.  The leaks were so severe that the walls were removed numerous times in the first year.  Brian Stolar of Pinnacle and Jonathan Litt of Kohl have been unable to repair my unit successfully and Brian Stolar of Pinnacle has regularly shirked any responsibility whatsoever for the conditions that my unit is in.  There is currently litigation against Brian Stolar and Jonathan Litt as they have left us with no other choice but to sue.  Do the residents of Montclair really want Brian Stolar, Pinnacle Companies or any of their subsidiaries or joint partnerships at the helm of such a vital project?

A resident of the Siena at Montclair saw the usual suspects 'caulking' the outside of the building.  Two representatives from Kohl were busy at work - the same two individuals who have been performing work in my unit (and throughout the building - yes, even caulking) since 2008 to no avail.  Perhaps the past caulking episodes were just mock runs and the guns have been loaded this time.........

Eagle Eye Resident Snaps Sponsor Fix

An eagle eyed (not really all that eagle eyed as the giant chunks of missing stucco are pretty obvious!) resident at The Siena at Montclair snapped this photo of the exterior of the building.  What was previously bubbling stucco has been removed and is apparently in the process of being repaired.  Will it be a 'Tiled Tuscany' repair in the spirit of the building or will it be a drive by caulking?  Only time will tell!

The weather this past week was rough, but for the residents of The Siena at Montclair, it was just another round of leaky windows, garages and ceilings.  Every rain storm in my apartment is like torrential rains - click on the photo for a gallery of damage caused by the last storm.  The fact that these apartments remain in the shape that they do is enough reason to tell the City to SAY NO TO PINNACLE AND BRIAN STOLAR'S INVOLVEMENT IN THE MONTCLAIR GATEWAY PROJECT!

Empty Promises and Lip Service

In an email dated August 25th, 2011, Jonathan Litt of Kohl Construction conveyed that there would be staff on hand to aid the residents of The Siena at Montclair in the event of water damage.  The following email was sent from a unit owner who followed the prescribed protocol only to find that nobody from Pinnacle or Kohl was in the building to help with the water intrusion issues.  While the weather was extreme, Pinnacle Comanies and Kohl Construction have known for years that the building was prone to water intrusion even during normal rainfalls.  Please read on......


"Sue: Please don't take this personal, as you are only communicating what Kohl Construction asked you to communicate to the Siena Community.   Well, there was no one here to assist us. In my apartments there was as much water outside as inside.  As told, we asked the Concierge to call Nick Cocozza, but there was no Nick in site and still today, no news from Nick!.   I will be leaving on Sept. 2.  I can't leave my apartments in this conditions and I expect someone in my apartment Sept. 1 to solve my water issues before I leave!   We have had more than patience with these buffoons from Kohl and Pinnacle.  They are sending us these messages through you just to cover their asses but they are only a bunch of lies. There was no Nick Cocozza to assist us. EVER!.   I understand that everyone had their share of problems with Irene. But, then don't offer services that you are not going to supply."

Important E-mail from Jonathan Litt Regarding Hurricane Irene

'Dear Resident:   Jonathan Litt of Kohl Construction asked that I send this notification to the residents.   In anticipation of the upcoming hurricane, Kohl Construction will have staff available in case of any serious water intrusion.  Nick Cocozza of Kohl Construction will be the point person and will have assistance from Ken Bednarz of Pinnacle Communities along with some laborers and other staff.   Kohl Construction has advised that they are ready and willing to assist the residents of the Siena.  If you need this assistance, please reach out to the concierge on duty and they will then contact the point person, Nick Cocozza, on your behalf.'

I don't know that this even requires a commentary - the email speaks for itself. 
 

The Redevelopment Process

We recently met with Janice Talley, Director of Planning and Community Development and Nick Lewis, Third Ward Councilor to express our concerns with Pinnacle being chosen as the developer in the Montclair Center Gateway Redevelopment project.  Ms. Talley outlined how the process will work.  She explained that as DCH has chosen Pinnacle to represent them in the redevelopment negotiations, it is easier for the Township of Montclair to work with the chosen developer.  Should the Township wish complete control over the project, they would be forced to condemn the property under eminent domain.

While Ms. Talley and Mr. Lewis were gracious to take the time from their schedules to meet with us, does the Township really want reward Pinnacle for The Siena at Montclair?  Pinnacle has financially and emotionally crippled many of the unit owners of The Siena at Montclair who purchased their homes from them.  Unit owners who trusted Brian Stolar, Jonathan Litt, Pinnacle Companies and Kohl Construction.  Unit owners who are constantly faced with mold problems and persistent leaks.  Unit owners who now are unable to sell they units due to litigation.  Unit owners who are unable to live in units which were sold to them by Brian Stolar (but who still pay mortgages, taxes and maintenance fees).  Unit owners who are facing financial problems due to the leaks and mold.  Unit owners who have been trapped financially simply by trusting Brian Stolar?  I think not.

Pinnacle should not be at the helm of such an important project in Montclair.  They have shown a lack of accountability to the very people who trusted them to build their homes and rather than handle the problems head on, they have been 'negotiating' with the residents of The Siena while we suffer through every rain storm and snow storm, season after season.  If there was a true sense of accountability on the part of Pinnacle Companies, Kohl Construction and Herod Development, our homes would have been repaired by now - instead, the mold continues to fester.

Say no to Montclair Township working with Pinnacle to develop the most important project in Montclair in a generation. 

Caulkers.  Really?

In this email dated 12/19/2008, Pinnacle and Kohl have apparently come to the conclusion that a little caulk will solve all the leaking problems.  All I can say is that 'caulk is cheap'.

We have caulkers at the Siena today and they have caulked the areas of concern above unit 514 that we believe has been the cause of the prior leaks.  Mike has also checked the leak you mentioned in your living room and is addressing same today as well.

 

Given the upcoming inclement weather, Mike will be on site o monitor and confirm that these issues are at last behind us.

Brian Stolar has a very high opinion of the garage.  I suppose that he would, however, please see the video and photos below to see the 'very fine' and 'more than typical' garage that he refers to.  Not only have vehicles been damaged requiring costly repairs due to the water intrusion, two years later the problems still exist!

Raniya,   First of all, we will be glad to cut the check and send it to you directly, which will be done today. As to the leak and your related grievances, we are more than apologetic despite the fact that we engaged one of the most highly respected engineers to design the corrective work, which was also vetted by the project architect. Of course, you know that we are doing our level best and we will continue to do so until it is resolved completely.   Since your attorney is copied on this email, I have copied the respective General Counsels for both Kohl and Pinnacle. My opinion is that attorney intervention is an extremely valuable and sometimes unavoidably necessary step when communication and cooperation break down. I would respectfully submit that this has not happened and that obviously we are working hard at this effort.   Notwithstanding our efforts towards a resolution of this matter, we are certainly not willing to fund another engineer to be engaged in this matter. I want to be clear on this point. Not only do we see this as a wasteful and distracting action that will yield no improved result. Is This the Sort of Accountability Montclair Wants in Redeveloping the DCH Site?  The issues are still unresolved as of today, August 8, 2011.

I would like to respond to your very strong emails. I respect and recognize that you are not satisfied with the service in rectifying your problems. I am very sorry that you even had any problems and even more so that we have not been able to resolve them to your satisfaction.

 

I started Pinnacle in 1984 and we have had only a handful of dissatisfied customers out of thousands of homes that we have built over these 25 years. You may want to ask Ed to inquire of his brother Allen, an architect whom I have known since the late 80’s. who is very familiar with our track record and company reputation. The NJ State Department of Community Affairs, which regulates and licenses builders, will also tell you the same information. While I know that this does not help resolve your issues, this consistent background of high quality development and customer appreciation should make it clear that we do not walk from any issues.

 

You both state in your emails that we are ignoring the problems and that the investment that you have made is losing value since the building is so problematic. This is not the case and we have not ignored anything. As our partner, the Kohl Group has handled the construction. Although there have been issues, Jonathan Litt, who is one of the main principals in the company, has personally spent his time and energy, day and night to resolve issues. There have been communication issues and I know that Jonathan is doing his best to be responsive, but as we stated in the meeting the other day, most of the delays in our responsiveness are a result of us trying to get a vendor to respond. The company who installed the exterior walls and windows is bankrupt, the maker of the flooring, Armstrong Corporation, is a $3B company, who has been very difficult to pin down, etc. etc. We described the situation with Armstrong at the meeting and progress is being made.

 

In summary, we will pursue all issues and resolve them. Conversely, we must consider our own reputation, our investment in the building and the investment values for the residents. Accordingly, any public statements made by you or other residents which are intended to foment action by others are of great concern to us if they are inflammatory or inaccurate. Much of what has been said by you and others is unfortunately true and we apologize for that and we are committed to resolve as I stated above; however, there have also been statements that are quite untrue. There have also been extremely negative overtures to others, including potential buyers. These actions and statements are of great concern to us and if they continue, we will have no choice but to protect ourselves. I hope that this is not necessary.

 

Although I have personally been caught out emotionally by Marien, Vin and Raniya, I have a good relationship with everyone else in the building and I will try my best not to react to any statements that are genuine, albeit argumentative.  Jonathan feels the same way.  The lawsuits that were filed By Vin and Raniya obviously make this much harder, but we will do our best. Our offices are always open to communication with any resident at Siena.

This email dated almost three years ago was the result of my trying to gather the unit owners together to demand that our issues be resolved.  I papered the building to get everyone together to discuss what was happening with the leaks and Mr. Stolar responded in his usual manner. 

Vin,

 

I wanted to pass this message below from our sales office onto you just as I received it. I am glad that we actually got to meet and we are on top of getting everything resolved for you. As to the mold testing, we already do so for any leak that occurs, including yours and I have asked Jonathan Litt and his team to make sure that you get a copy as you requested. Jonathan also contacted Obed directly and they are speaking, so I appreciate your advice on that.

 

As to your continuing activities against us as described below, I have two comments for you to consider. The first is that it should be obvious to you that interfering with sales is not a good idea for a host of reasons and it is something that we clearly cannot continue to permit, but for you and Carlton, it creates the possibility of reducing the value of  the home that you bought. That can’t be a good thing for both of you, especially in this market, where any bad news is multiplied and has a larger than life impact on real estate values.

The second point that I would like you to consider is that we have as a company, only so many hands and minds to focus on and execute the management of the issues that have developed. That the cause of the problems was outside our control and most certainly not intended is irrelevant, as we can just handle so much at one time. Any time we spend responding to the groundswell that you create just reduces the time that we can spend on resolving the issues at hand.

 

I told you in the lobby last week that we would get everything resolved for you and we have people focused on doing just that. We will also make good on the commitments to both of you for the Murphy bed and making sure that the room and its contents look perfectly new.

 

I would appreciate your cooperation in getting this behind all of us without further inflammatory actions that will serve only to detract, rather than focus or accelerate a resolution.

FYI: Vin Forbes of unit 514 has been slipping a letter under all resident doors stating his issues with the leaks and going as far as stating that there is also mold and requesting that everyone get together to demand environmental testing throughout the entire building. He continues by stating that he has created a web group where residents can voice their complaints so that they can all protect their investments. Vin has also stopped prospects on their way up to the sales office to inform them of this situation and to warn them against buying.

 

I’m not sure how this will affect sales going forward but wanted you to be aware of this situation.

Letter From a Renter at The Siena  (names have been removed to protect privacy)

Regretfully, please allow this email to serve as a formal notice.  As you know, I have been a good tenant for over a year. I always pay my rent on time and care for this apartment as if it were my own.  However, I can no longer tolerate the extraordinary deterioration of the condition of this place due to all the leaks.  I am searching for another place and plan to move out as soon as I find another apartment.  This is horrible!

 The apartment has had gushing water through the windows, walls and ceiling every time it rains for months and months.  It is non-stop.  The water has destroyed the window cells, woodwork, the walls and ceilings, my furniture, bedding and window treatments.  There have been repairs and more repairs only to have the rain and gushing leaks return to re-destroy everything!  Now the repairs are in a state of “half complete” so I have unpainted walls and falling plaster!  Even the floor is starting to warp.  It is ridiculous!

 What is the most disturbing and dangerous is the mold that is growing on the walls from moisture that is inside the building.  The apartment is beginning to smell musty and moldy.  I am worried that there is a health hazard growing that will seriously and permanently destroy my health.  I am beginning to cough, my eyes burn, and I often feel nauseous after I am in the apartment for more than a few days.  After I move out you cannot in good conscientiousness rent this place to anyone else until the damage is fixed, the mold cleaned up and the leaking is permanently, completely stopped!

This statement was made by Herod Decelopment, LLC (the partnership between Pinnacle Companies and Kohl Construction) almost NINE months ago.  In that time, Ms. Kassem's apartment has not been rendered habitable and she is still living in another unit in The Siena, paying a mortgage, taxes and maintenance fees on a unit in which she can neither sell nor live in.  Does Montclair need another liability at the DCH site in which innocent, hardworking taxpayers are financially trapped in unhealthy situations?  Click on the photo to be taken to the report by Fox News.

I wanted to take a few moments to express my deep concern regarding the redevelopment of the DCH site.  As a unit owner at The Siena at Montclair, my unit has been plagued by water intrusion from windows, mold in the interior of my unit, walls which have been removed for extended periods, an underground garage which leaks and repairs which have never been made to prevent further water intrusion into my unit.  I reported the first leaks in my unit approximately three weeks after closing in January of 2008 and to date, satisfactory and lasting repairs have not been made.  I currently have a tenant who is vacating the apartment as there was a water leak in her bedroom which destroyed her property and left visible black mold in the unit.  Pinnacle and Kohl began the repair approximately three months ago, and to date, have failed to repair the unit to prevent further intrusion or to even render it habitable.  My tenant has been sleeping on a pull out sofa which she has had to pull away from the window due to water damage and intrusion.  As a result, my partner, Carlton Schultz and I now own a unit which due to lack of a permanent solution, has been rendered unrentable and uninhabitable.  Not only has this proven to be financially draining, but has been emotionally devastating.

We have been involved in a lawsuit with the builder and  developers.    The board of The Siena at Montclair recently elected to sue Pinnacle, Kohl and the LLC under which they do business, Herod Development LLC., to name a few of the defendants.  An independent engineering report was also conducted in 2010, by Falcon Engineering, which outlined a number of serious issues with the construction of the building.  I would be happy to provide you with this report in addition to photos of the years of water intrusion, missing walls, mold and other problems in my own unit.

I urge everyone involved to closely examine any development plans and to take into great consideration the many issues at The Siena.  They marketed luxury units and what we have ended up with are units which are not habitable.  The Siena at Montclair has become a financial burden on every taxpayer who purchased a home to live in at The Siena .  I hope that any plans to award any kind of contracts or allow Pinnacle and/or Kohl (or any of their subsidiaries or development ventures) to build another structure in the heart of Montclair will be taken with consideration of all of the construction issues at The Siena at Montclair.  The last thing that Montclair needs is yet another blight in its core business district, one that will end up draining more resources from the Montclair Township, rather than adding to its financial health and economic vibrancy.

As a meeting regarding the redevelopment is taking place tomorrow and I will be unable to attend, as a taxpayer in Montclair, I would like my concerns to be known.  Again, I am more than happy to offer an engineering reports outlining the Siena's deficiencies, photos of my unit over the past three years or anything else which may be beneficial to if Pinnacle and Kohl are being considered in this project.

It is truly unfortunate that Vince, Carlton and others have had problems with their homes. We have been in business over 25 years and we have built many residential projects in New Jersey. Our track record of creating and developing successful projects is significant and we have had a tremendously low record of any problems whatsoever.

 

Siena is a Joint Venture with another developer, and for the record, they are not involved with the DCH project. We and our joint venture partner are addressing as best as possible the problems at Siena, which were caused by others. We also regret that Vince, Carlton and the condominium association have elected to institute litigation, which in my opinion just slows down the process and obviously makes it impossible for us to comment publicly.

Dear all:

 

First and foremost, I am glad to see that Mr. Stolar acknowledges that it is "truly unfortunate that Vince, Carlton and others have had problems with their homes".  However, what Mr. Stolar fails to note is that virtually everyone else has problems with their homes as well.  Moreover, the few individuals who have not yet experiences the horrific issues with their units are nevertheless effected by the multitude of issues that infect our respective units, the common areas and the building as a whole.  Indeed, it is these facts that have now caused the Association to institute litigation against the same host of defendants that are in both the Schultz and Kassem cases.  Therefore, we are all paying for the issues that Mr. Stolar and his cast of characters have caused and/or have failed to cure.  Moreover, we have heard the same old story time and time again from Mr. Stolar and his disciples for over two years now with absolutely no results.  In fact, the situation at the Siena continues to get worse on a daily basis.  Therefore, while I do not necessarily believe Mr. Stolar's claims regarding his track record at other projects, I am not concerned with other projects.  What we all should be concerned about is the Siena and the issues that we are facing at this project.  That is the only issue and it is those issues that are costing us all a great deal of time, money and aggravation. Mr. Stolar has also failed to note that as we continue to receive lip service and empty promises, the building continues to deteriorate making it obvious to all owners that we have real and significant issues which should have been address years ago.

 

Mr. Stolar's claims they are doing everything that they can belies the fact that my unit has been in a state of disrepair since we closed on the unit.  His claims belie the fact that Ms. Kassem has been unable to live in her unit for 2+ years due to water intrusion.  His claims are also belied by his own expert's reports that cite numerous problems throughout the building.  The Association has now instituted suit against Mr. Stolar and his cohorts and we have received the bill for the same, which is literally in the hundreds of thousands of dollars.  This is all due to the fact that there are serious issues with the building that they have failed to address.  They have previously tried to try to pit unit owners against Ms. Kassem and Carlton and I in a misguided effort to shield their own liability.  Now with the commencement of litigation by the Association and the continue destruction and decay of the building I am sure everyone realizes that we are all the victims of their conduct and that we are all in this together.  As evidenced by his response (which has been his mantra for the past three years), Mr. Stolar is shirking any responsibility in the construction defects and shifting the blame to his 'joint partners'.  We tried in earnest for two years to persuade both Mr. Stolar and Mr. Litt to repair our homes to no avail and were left with no choice other than litigation.  Litigation was the last resort for the resolution of the water intrusion, mold and empty promises which are now adversely affecting all of us in a very serious and real way.

We would welcome the opportunity to speak with you further regarding the conditions of our units and the common areas of the building and would be willing to take you into the units to see the issues first hand.  Ms. Kassem will in attendance at the township meeting tomorrow and can answer any questions you may have. I am a firm believer in the fact that if you want to see what someone really means do not listen to what they say watch what they do. If you take the time to watch what Mr. Stolar and his co-defendants have done irrespective of their empty promises you will see that they have not done anything to honestly deal with this situation, which is sad but all too true.
